Terms of Use
These terms are an agreement between you and Osira Labs, Inc., 838 Walker Road, Suite 21-2, Dover, DE 19904, USA (“Osira”, “we”), for the Osira app and the website osira.tv (together, the “service”). By using the service you accept them. Our Privacy Policy explains how we handle your data.
1. Who can use Osira
You must be at least 16 years old. Some shows contain violence and mature themes; the App Store age rating tells you what to expect.
2. Your account
You can watch as a guest or sign in with Apple, Google or an email code. Keep access to your sign-in method secure — you are responsible for what happens in your account. You can stop using Osira at any time and ask us to delete your account.
3. What you may do with our content
We give you a personal, non-exclusive, non-transferable licence to stream the shows in the service for your private, non-commercial use. You may not:
- download, record, copy or redistribute shows, except where the app offers it;
- show them publicly or use them commercially;
- bypass technical protection, or scrape or bulk-collect content or data;
- decompile or reverse engineer the app, except as far as the law allows despite this restriction;
- disrupt the service or access it by automated means we have not allowed.
The shows, artwork, names and logos belong to us or our licensors. The catalogue changes over time; shows can be removed, for example when a licence ends.
4. Osira Pass and purchases
Osira is free during launch. If we offer paid content or an Osira Pass subscription, you buy it through Apple’s App Store, and Apple’s terms apply to the purchase. The price and billing period are shown before you buy. Subscriptions renew automatically until you cancel them in your Apple account settings at least 24 hours before the end of the current period. Apple handles payments and refunds, including any statutory right of withdrawal.
5. Changes to the service
We keep developing Osira and may add, change or remove features and content. We aim for the service to be available at all times but cannot guarantee uninterrupted access, for example during maintenance.
6. Ending the agreement
You can end this agreement at any time by deleting your account and the app. We may suspend or close an account that seriously or repeatedly breaks these terms or the law; unless the breach is severe, we will warn you first. Paid subscriptions you have already bought remain subject to Apple’s refund rules.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law provides for liability (for example product liability). For slight negligence we are liable only for breach of an obligation that is essential for the service and on which you may rely, limited to the damage typically foreseeable when the agreement was made. Otherwise our liability for slight negligence is excluded. These limitations also apply to our staff and agents.
8. Apps from Apple’s App Store
These terms are between you and us, not Apple. Apple is not responsible for the app, its maintenance or support, or for any claims relating to it — including product liability, legal or regulatory compliance, and intellectual property claims. If the app fails to meet an applicable warranty, you may notify Apple, which will refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9. Changes to these terms
We may update these terms, for example when the service or the law changes. We will tell you about significant changes in the app or by email before they take effect. If you do not agree, you can stop using Osira and delete your account.
10. Applicable law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. If you are a consumer living in the European Union, you also keep the protection of the mandatory laws of your country of residence, and you can bring claims in the courts there.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
